Community Guidelines and Legal Agreement for Pneumapsyche
Please read these Terms of Service carefully before using Pneumapsyche. By accessing or using our services, you agree to be bound by these terms. If you do not agree, please do not use our services.
Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Pneumapsyche (“we,” “us,” “our,” or the “Platform”) governing your access to and use of the Pneumapsyche website, community platform, and all related services (collectively, the “Services”).
By creating an account, accessing, or using any part of our Services, you acknowledge that:
- You have read, understood, and agree to be bound by these Terms;
- You agree to our Privacy Policy, which is incorporated herein by reference;
- You agree to our Community Guidelines;
- You have the legal capacity to enter into this agreement.
Eligibility
To use our Services, you must:
- Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater;
- Have the legal capacity to enter into a binding agreement;
- Not be prohibited from using the Services under applicable laws;
- Not have been previously suspended or removed from our Services.
Our Services are not intended for individuals under 18 years of age. We do not knowingly collect personal information from minors. If you are under 18, please do not register or provide any personal information.
Account Registration and Security
3.1 Registration Requirements
To access certain features of our Services, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete registration information;
- Maintain and promptly update your information to keep it accurate;
- Choose a username that does not infringe on others’ rights or violate our guidelines;
- Select a strong, unique password.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials;
- All activities that occur under your account;
- Immediately notifying us of any unauthorized use of your account;
- Ensuring your account information remains secure.
3.3 Member Types
Our community recognizes different types of members:
- Lived Experience: Individuals with personal mental health experiences
- Family Ally: Family members supporting loved ones
- Friend/Ally: Friends and supporters of the community
- Professional: Mental health professionals and advocates
- Supportive Community Member: General community supporters
Community Standards
Pneumapsyche is committed to creating a safe, supportive environment for all members. Our mission is “an enterprise against stigma and hate.” All members are expected to:
- Treat all community members with respect and dignity;
- Use trauma-informed language and approaches;
- Maintain confidentiality of shared experiences;
- Report concerning content or behavior to moderators;
- Support peers without providing medical or clinical advice;
- Respect boundaries and consent.
User Content
5.1 Content Ownership
You retain ownership of all content you submit, post, or display through our Services (“User Content”). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with providing and improving our Services.
5.2 Content Standards
You represent and warrant that your User Content:
- Does not violate any applicable laws or regulations;
- Does not infringe any intellectual property or privacy rights;
- Is not defamatory, obscene, or otherwise objectionable;
- Does not contain harmful code or malware;
- Does not constitute professional medical advice.
5.3 Sensitive Content
Given the nature of our community, we understand that some discussions may involve sensitive topics. When sharing experiences:
- Use appropriate content warnings when discussing potentially triggering topics;
- Be mindful of others’ emotional wellbeing;
- Do not share content that glorifies self-harm or suicide.
Prohibited Conduct
You agree NOT to:
- Harass, bully, intimidate, or threaten other users;
- Post hate speech, discriminatory content, or content promoting stigma;
- Impersonate others or misrepresent your identity or credentials;
- Share others’ personal information without consent;
- Provide medical diagnoses or clinical treatment recommendations;
- Solicit personal relationships or engage in predatory behavior;
- Use the platform for commercial solicitation or spam;
- Attempt to circumvent security measures or access restricted areas;
- Upload malicious code, viruses, or harmful content;
- Violate any applicable laws or these Terms.
Intellectual Property
All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, and compilation thereof, are the exclusive property of Pneumapsyche or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or distribute our proprietary content without permission;
- Use our trademarks or service marks without authorization;
- Create derivative works based on our Services;
- Reverse engineer or attempt to extract source code.
Disclaimers
PNEUMAPSYCHE IS A PEER SUPPORT AND ADVOCACY PLATFORM. WE DO NOT PROVIDE MEDICAL, PSYCHIATRIC, PSYCHOLOGICAL, OR CLINICAL SERVICES. CONTENT SHARED ON OUR PLATFORM IS FOR INFORMATIONAL AND PEER SUPPORT PURPOSES ONLY AND SHOULD NOT BE CONSIDERED A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Services will be uninterrupted, secure, or error-free;
- User Content is accurate, reliable, or appropriate;
- Any defects or errors will be corrected;
- The Services are free of viruses or harmful components.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PNEUMAPSYCHE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Services;
- Any conduct or content of any third party on the Services;
- Any content obtained from the Services;
- Unauthorized access, use, or alteration of your content.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.
Indemnification
You agree to defend, indemnify, and hold harmless Pneumapsyche and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Services;
- Your User Content;
- Your violation of these Terms;
- Your violation of any rights of another party.
Termination
11.1 By You
You may terminate your account at any time by contacting us or using account deletion features. Upon termination, your right to use the Services will immediately cease.
11.2 By Us
We may suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that we believe:
- Violates these Terms or our policies;
- Is harmful to other users or the community;
- Is illegal or potentially exposes us to liability.
11.3 Appeals
If your account is suspended or terminated, you may submit an appeal to appeals@pneumapsyche.com. Appeals will be reviewed within 30 days.
Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
12.2 Informal Resolution
Before initiating any formal dispute resolution, you agree to contact us first to attempt to resolve the dispute informally. Most disputes can be resolved through direct communication.
12.3 Arbitration
Any dispute arising from or relating to these Terms that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the arbitrator’s decision shall be final and binding.
12.4 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
- Posting the updated Terms on our website;
- Updating the “Effective Date” at the top of these Terms;
- Sending an email notification to registered users for significant changes.
Your continued use of the Services after any modifications indicates your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Services.
